These terms and conditions apply to all competitions conducted by PREMATCH Sports Ltd. or its legally affiliated companies (collectively referred to as "Prematch") on the websites they operate and within the mobile application "Prematch," where these conditions are referenced. Additional conditions for individual competitions take precedence over these conditions. Unless otherwise stated, prematch is the sole organiser of the competitions. The times given are based on the German time zone.

Eligibility

1. Participation is open to any natural person with a permanent residence in England. Persons under the age of 18 are excluded from participation. Persons with limited legal capacity who have reached the age of 14 are eligible to participate, subject to statutory provisions, only if Prematch explicitly allows it for the respective competition and with effective consent from their legal guardians. Legal representatives, employees of PREMATCH Sports Ltd., and their affiliated companies, as well as their relatives up to the second degree, are not eligible to participate. Ineligible persons will not be entitled to any prize even if selected.

Participation

1. Each participant may only enter in their own name. Prizes are non-transferable.

2. Participation may require the provision of mandatory and voluntary information such as name, address, Prematch Profile, team and contact details. All personal data will be handled by Prematch in accordance with the privacy policy and any additional consent given. As consideration for participation, Prematch may process the provided data to send participants newsletters about products, services, events, and promotions via email.

3. All information provided for participation must be truthful. Failure to comply may result in disqualification.

Material Submissions

If participation requires the submission of materials, the following applies:

1. Participants must not submit any unlawful, discriminatory, harmful, pornographic, racist, or extremist content. Participants indemnify Prematch against any third-party claims arising from such submissions.

2. Participants must own all rights to the submitted materials and indemnify Prematch against any third-party claims.

3. Participants grant Prematch an exclusive, transferable, and royalty-free right to use the materials without any time, spatial, or content restrictions.

4. Participants transfer ownership of the submitted materials to Prematch unless explicitly stated otherwise in writing within 10 days of the competition's conclusion. After this period, Prematch may destroy all submitted materials.

Liability and Modifications

1. Prematch is not liable for any issues or defects related to computers, connections, networks, etc., used by participants to send entries.

2. Prematch is liable for submitted materials only in cases of intentional or gross negligence by its employees or third parties it commissions.

3. Prematch reserves the right to replace announced prizes with others, change the competition process, or cancel the competition due to legal changes or court orders. In such cases, participants have no claims against Prematch.

Winner Selection and Notification

1. Winners are determined by Prematch, its employees, agents, or commissioned third parties by e.g. lottery. Prematch is not liable for slight negligence in winner determination.

2. Winners will be notified in writing (via post, email, whatsapp) or by phone. Winners must confirm their acceptance within five business days. If notified by phone and unreachable, Prematch will leave a message if possible, requiring the winner to respond within three business days. Failure to comply will result in loss of the prize, and Prematch may select a new winner. Initial winners have no claims against Prematch in such cases.

Prizes and Responsibilities

1. Prizes are limited to the published specifications. Additional services or costs, such as equipment required to use the prize or travel expenses, are not included unless explicitly stated. Winners are responsible for any additional costs, expenses, or services not included in the prize. Prematch is not liable for any damages caused by participants and is indemnified against any third-party claims.

2. Participants violating specific game rules or these conditions may be excluded from participation without prior notice.

3. Use of bots, artificial intelligence, or fake accounts to increase winning chances is prohibited.

4. Legal recourse is excluded.

Data protection

1. Data provided by participants (phone number, name, etc.) will be used to inform them about participation conditions, using WhatsApp for contact.

2. By taking part, participants consent to the use of their personal data for winner announcements and participation updates.

3. Data Retention: Personal data provided in private messages are used only for prize dispatch and stored only as long as necessary for the competition. Address data may be shared with partners for prize delivery.

Jurisdiction and Dispute Resolution

1. UK law applies. For merchants, public law entities, or public law special funds, London is the agreed jurisdiction.

2. In compliance with Directive 2013/11/EU, the EU Commission provides an online dispute resolution platform accessible at http://ec.europa.eu/consumers/odr. PREMATCH Sports Ltd. does not participate in such dispute resolution procedures.

Special Conditions for "Winter" giveaway

1. The giveaway starts on 9th January 2025 at 18:00 GMT and ends on 31th January 2025 at 23:59 GMT. Participation is open to all adults with a postal address in England. Minors require parental consent. Persons under 14 are excluded.

2. Prize: 1 of 3 Premier League shirts of choice with a total value of up to €200. Cash payout is excluded. 1 of 5 Derbystar Prematch footballs.

3. Registration: Participants fill out the In-App message directly in the Prematch-App and are qualified. The winners will be selected randomly out of all qualified participants and gets notified until Feb. 10th.

4. Notification: Winners will be notified via WhatsApp or E-Mail. Failure to respond within 3 days results in forfeiture of the prize without selecting a new winner.

By participating in the competition, participants accept these terms and conditions. Should any provisions be invalid, the remaining terms remain effective. Invalid provisions will be replaced with appropriate ones that best serve the intended purpose.
